おやすみシャッフル 利用規約

本利用規約（以下「本規約」）は、おやすみシャッフル（以下「本アプリ」）の利用条件を定めるものです。本アプリをダウンロードまたは使用することにより、お客様は本規約に同意したものとみなされます。本規約に同意いただけない場合は、本アプリの使用をお控えください。

第1条（サービスの説明）

おやすみシャッフルは、認知シャッフル法に基づく睡眠支援・リラクゼーションアプリです。ランダムな単語の読み上げを聴くことで、思考のループを穏やかに手放し、自然な眠りへの準備を手助けします。

本アプリは以下の機能を提供します：

第2条（医療に関する免責事項）

本アプリは睡眠支援およびリラクゼーションを目的としたツールであり、認知シャッフル法に基づいています。本アプリは医療機器ではなく、医学的なアドバイスや治療を提供するものではありません。

本アプリは、不眠症その他の睡眠障害の診断、治療、治癒、または予防を目的としたものではありません。睡眠に関する健康上の懸念がある場合は、医師または資格を有する医療専門家にご相談ください。

本アプリの使用は、医療専門家による医学的助言、診断、または治療の代替となるものではありません。

第3条（サブスクリプション）

3.1 プラン構成

本アプリは、無料プランと有料プラン（Pro）を提供しています。

3.2 料金と自動更新

Proプランは、月額プランおよび年額プランとして提供されます。料金は、Apple App Store内の購入画面に表示される金額に準じます。

サブスクリプションは、現在の期間が終了する24時間前までにキャンセルされない限り、同一の料金で自動的に更新されます。

3.3 課金と支払い

サブスクリプション料金は、購入確認時にお客様のApple IDアカウントに紐づけられた支払い方法に対して請求されます。すべての支払いはApple Inc.を通じて処理されます。

3.4 キャンセル方法

サブスクリプションのキャンセルは、iOSの「設定」アプリから以下の手順で行えます：

  1. 「設定」>「Apple ID」>「サブスクリプション」を開く
  2. 「おやすみシャッフル」を選択する
  3. 「サブスクリプションをキャンセル」をタップする

キャンセル後も、現在の課金期間の終了までサービスをご利用いただけます。

3.5 返金

返金については、Apple Inc.の返金ポリシーに準じます。返金のご請求は、Apple サポートを通じて直接Apple Inc.にお問い合わせください。

第4条（知的財産権）

本アプリに含まれるすべてのコンテンツ（テキスト、画像、音声、音楽、デザイン、ソフトウェアのソースコードを含むがこれに限らない）に関する知的財産権は、当社または正当な権利を有する第三者に帰属します。

お客様は、本アプリを個人的かつ非商用的な目的でのみ使用することができます。本アプリのコンテンツの複製、改変、配布、公開、リバースエンジニアリング、またはその他の不正使用は禁止されています。

第5条（禁止事項）

お客様は、本アプリの使用にあたり、以下の行為を行ってはなりません：

  1. 本アプリの不正な改変、リバースエンジニアリング、逆コンパイル、または逆アセンブル
  2. 本アプリを利用した違法行為または公序良俗に反する行為
  3. 本アプリのサーバーまたはネットワークに過度な負担をかける行為
  4. 第三者の権利を侵害する行為
  5. 本アプリのコンテンツを無断で商用利用する行為
  6. 本アプリの提供するサービスを医療行為の代替として利用する行為
  7. その他、当社が不適切と判断する行為

第6条（サービスの変更・中断・終了）

当社は、事前の通知なく、本アプリの内容を変更し、または本アプリの提供を一時的に中断もしくは終了することがあります。サービスの変更、中断、または終了によってお客様に生じた損害について、当社は一切の責任を負いません。

第7条（免責事項・責任の制限）

  1. 本アプリは「現状有姿」で提供されます。当社は、本アプリの正確性、完全性、有用性、特定目的への適合性について、明示または黙示を問わず、いかなる保証も行いません。
  2. 当社は、本アプリの使用または使用不能から生じるいかなる損害（直接損害、間接損害、偶発的損害、特別損害、結果的損害を含む）についても、予見の有無にかかわらず、一切の責任を負いません。
  3. 当社の責任が認められる場合であっても、その賠償額はお客様が直近12か月間に本アプリに対して支払った金額を上限とします。
  4. 本アプリは睡眠の改善を保証するものではありません。効果には個人差があります。

第8条（個人情報の取り扱い）

お客様の個人情報の取り扱いについては、別途定めるプライバシーポリシーに従います。本アプリをご利用いただくにあたり、プライバシーポリシーにもご同意いただく必要があります。

第9条（規約の変更）

当社は、必要に応じて本規約を変更することができます。重要な変更がある場合は、本アプリ内での通知またはその他の適切な方法でお客様にお知らせします。変更後の規約は、本アプリ内に掲示された時点で効力を生じます。変更後も本アプリの使用を継続された場合、お客様は変更後の規約に同意したものとみなされます。

第10条（準拠法および裁判管轄）

本規約は日本法に準拠し、日本法に基づいて解釈されるものとします。本規約に関連する紛争については、熊本地方裁判所を第一審の専属的合意管轄裁判所とします。

第11条（分離可能性）

本規約のいずれかの条項が無効または執行不能と判断された場合でも、残りの条項は引き続き完全に効力を有するものとします。

These Terms of Service (“Terms”) govern your use of the Oyasumi Shuffle application (“the App”). By downloading or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Description of Service

Oyasumi Shuffle is a sleep support and relaxation application based on the cognitive shuffle technique. By listening to random words being read aloud, the App helps you gently let go of racing thoughts and prepare for natural sleep.

The App is not intended to diagnose, treat, cure, or prevent insomnia or any other sleep disorder. If you have health concerns related to sleep, please consult a physician or qualified healthcare professional.

Use of the App is not a substitute for professional medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay in seeking it because of information provided by the App.

3. Subscription Terms

3.1 Plan Structure

The App offers a free plan and a paid plan (Pro).

3.2 Pricing and Auto-Renewal

The Pro plan is available as a monthly or annual subscription. Pricing is as displayed on the purchase screen within the Apple App Store.

Subscriptions automatically renew at the same price unless cancelled at least 24 hours before the end of the current billing period.

3.3 Billing and Payment

Subscription fees are charged to the payment method associated with your Apple ID account upon confirmation of purchase. All payments are processed through Apple Inc.

3.4 How to Cancel

You can cancel your subscription through the iOS Settings app:

  1. Open Settings > Apple ID > Subscriptions
  2. Select “Oyasumi Shuffle”
  3. Tap “Cancel Subscription”

After cancellation, you will continue to have access to the service until the end of your current billing period.

3.5 Refunds

Refunds are subject to Apple Inc.’s refund policy. To request a refund, please contact Apple Inc. directly through Apple Support.

4. Intellectual Property

All content included in the App, including but not limited to text, images, audio, music, design, and software source code, is the intellectual property of the developer or authorized third parties.

You may use the App solely for personal, non-commercial purposes. Reproduction, modification, distribution, publication, reverse engineering, or any other unauthorized use of the App’s content is prohibited.

5. Prohibited Uses

When using the App, you must not:

  1. Modify, reverse engineer, decompile, or disassemble the App without authorization
  2. Engage in illegal activities or activities contrary to public order and morals through use of the App
  3. Place excessive load on the App’s servers or network
  4. Infringe upon the rights of third parties
  5. Use the App’s content for unauthorized commercial purposes
  6. Use the services provided by the App as a substitute for medical treatment
  7. Engage in any other conduct deemed inappropriate by the developer

6. Service Modifications, Suspension, and Termination

The developer may modify the content of the App or temporarily suspend or terminate the provision of the App without prior notice. The developer shall not be liable for any damages incurred by users as a result of such changes, suspensions, or terminations.

7. Disclaimer of Warranties and Limitation of Liability

  1. The App is provided on an “as-is” basis. The developer makes no warranties, express or implied, regarding the accuracy, completeness, usefulness, or fitness for a particular purpose of the App.
  2. The developer shall not be liable for any damages arising from the use or inability to use the App, including but not limited to direct, indirect, incidental, special, or consequential damages, regardless of whether such damages were foreseeable.
  3. In the event that the developer is found liable, the maximum amount of compensation shall be limited to the total amount paid by the user for the App in the 12 months immediately preceding the claim.
  4. The App does not guarantee improvement of sleep. Results may vary between individuals.

8. Handling of Personal Information

The handling of your personal information is governed by our separately established Privacy Policy. By using the App, you also agree to the Privacy Policy.

9. Changes to These Terms

The developer may modify these Terms as necessary. Users will be notified of significant changes through in-app notifications or other appropriate means. Modified Terms take effect upon publication within the App. Continued use of the App after changes have been made constitutes acceptance of the modified Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Kumamoto District Court as the court of first instance.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
